The Anglo-Dutch oil firm Shell has won a multimillion-dollar court battle against the Indian authorities, marking a significant victory for multinationals involved in tax wrangles in the country. The high court in Mumbai ruled in favour of Shell, whose Indian unit had been accused of under-pricing shares issued to its parent firm by about 180bn rupees (£1.9bn). The company had challenged a demand by Indian authorities for tax on the interest that would have been earned. The judges quashed the income tax department order. “This is a positive outcome which should provide a further boost to the government initiatives to improve the investment climate,” Shell said in a statement. The high tax claim was one in a series ordered by Indian authorities on foreign firms including HSBC, IBM and Nokia. A court ruled in October in favour of the British mobile phone company Vodafone, which had been engaged in a £317m tax battle with Indian authorities after they accused it of also underpricing its shares. Foreign companies claim India’s tax laws are sometimes applied in an uneven and capricious manner, making it difficult to do business in the country. Vikram Dhawan, director of equities at Equentis Capital, described the ruling in the Shell case as “a very positive development”, which showed India “is walking the talk of being friendly and fair to businesses”. But he added that its government now had to remove the ambiguity about inward capital rules “if more of such suits that hurt investor sentiment are to be avoided”. Transfer pricing – the value at which companies trade assets between units in different countries – has become a significant legal issue in India and in other countries. Tax authorities often contend that companies set the prices for transferring assets for their own gain. Legally, prices for cross-border transfer of assets are supposed to be set as if the transactions were carried out with separate companies. The Federal Trade Commission may require the country’s No. 1 dollar store chain to divest more than 4,000 stores to win approval of its stalled $9.1 billion merger proposal, two sources close to the situation said Tuesday. There is concern among the FTC staff that the two chains are mainly in competition with each other — and not with Walmart, drugstores and supermarkets, the sources said. “The question is whether the [vastly increased] number of divestitures will allow [Dollar General’s] deal to work financially,” according to one source close to the situation. Getting the FTC to change its mind on what retailers are its biggest rivals could take as long as six months — but rival Dollar Tree, the No. 3 chain in the sector, wants a vote on its proposed Family Dollar merger by Dec. 31, according to insiders. "This is the third or fourth time they've been hit with punitive damages for doing the same thing," said attorney Sean Simpson, who is part of the legal team representing plaintiff Rosario Juarez, 43. "Let's hope they get the message." The award by a six-person jury, which follows a two-week trial, includes $872,720 in compensatory damages and another $185 million in punitive damages. Simpson said he expected the damage award to be substantially reduced on appeal. Representatives for the auto parts retailer did not immediately respond to requests for comment by phone and email. But company spokesman Ray Pohlman told the San Diego Union Tribune that the company intends to appeal.According to the complaint, Juarez was hired by AutoZone in 2000 as a customer service representative at a store south of San Diego. In April 2001, she was promoted to parts sales manager and in October 2004 to store manager. Then in September 2005, Juarez became pregnant with the first of her two children. President Barack Obama on Friday pledged a $3 billion U.S. contribution to an international fund to help poor countries cope with the effects of climate change, putting the issue front and center of the G20 Leaders Summit in Australia. The large size of the contribution took climate policy watchers by surprise and doubles what other countries had previously pledged ahead of a Nov. 20 deadline. It would be the second major move on climate change taken by Obama after big Democratic losses in last week's midterm elections. "Along with other nations that have pledged support, we'll help vulnerable communities with early-warning systems, stronger defenses against storm surges, and climate-resilient infrastructure," Obama said in remarks ahead of the official opening of the G20 summit. "We'll help farmers plant more durable crops. We'll help developing economies reduce their carbon pollution and invest in clean energy." The timing of the announcement was seen as putting pressure Australian Prime Minister Tony Abbott, who is hosting the summit and once described climate science as "absolute crap". The controversial pipeline next goes to a Senate vote, most likely Tuesday. House members voted Friday to approve the Keystone XL pipeline, the controversial spigot that would transport Canadian oil to the the Gulf Coast. A Senate vote is expected as early as Tuesday, with outcome far from certain. In the House, the measure passed 252-161, including 31 Democrats voting for its approval. If the pipeline is built, it would close a gap between South Dakota and Nebraska, totaling 1,179 miles. Around 800,000 barrels of crude could flow daily to the Gulf Coast. President Obama has opposed previous versions of the bill and has signaled that he may veto the current version if it is passed, saying that the State Department should have the ultimate say over cross-border pipelines. WTO agreements require ratification by all member countries. India and the U.S. did not announce details of their new deal, but India had objected to a four-year limit on a so-called "peace clause" that protected developing nations from being punished if they breached the WTO's cap on food subsidies. To ensure poor farmers continue to grow grain, even when market prices are low, India guarantees them a certain price and then stores the crops either for welfare or sale on the open market. India is one of the world's largest grain exporters and the low cost of its production and procurement system means it can sway world prices. Both countries said their agreement should clear the way for immediate implementation of the WTO pact. "We are extremely happy that India and the U.S. have successfully resolved their differences related to the issue of public stockholding for food security purposes," India's Commerce and Industry Minister Nirmala Sitharaman said in a statement. The India-U.S. agreement, now headed for review by the WTO's general council, was announced as both Prime Minister Narendra Modi and President Barack Obama were visiting Myanmar for regional summits. Los Angeles Clippers forward Blake Griffin has been charged with one count of misdemeanor battery for an incident in a Las Vegas nightclub last month. According to the filing Wednesday in the Clark County District Attorney's office, Griffin "wilfully and unlawfully used force or violence" on Oct. 19 on Daniel Schuman, squeezing Schuman's hand and shoulder and/or slapping him on the face. According to reports at the time of the incident, Griffin was upset by camera flashes in his face and grabbed Schuman's phone. Teammates DeAndre Jordan and Chris Paul were with Griffin at the club that night but were not involved in the alleged incident. According to police, the maximum penalty if convicted is six months in jail and/or a $1,000 fine. Court records obtained Wednesday show Griffin is due for arraignment Dec. 8 before a Las Vegas justice of the peace. Team spokesman Seth Burton says the Clippers are aware of the complaint, but have no immediate comment. Clippers coach Doc Rivers commented on the situation last month, saying: "I trust Blake 100 percent. He's a great kid. We'll figure it out and get through it." FRANKFURT — The Financial Stability Board, a panel made up of central bankers, finance officials and top regulators from the world’s largest economies, plans to announce proposals Monday that would double the amount of money that large banks would be required to have on hand to absorb losses.
The purpose of the new rules, which would not take effect until 2019 at the earliest, is to curtail risk-taking and protect taxpayers from having to bail out large banks in times of crisis, as happened on a grand scale during the financial crisis in 2008. The new proposals, which have been hinted at for several weeks, aim to shift the burden of bank failures so that it falls more squarely on bank investors and the banks themselves. But the proposals are certain to face stiff opposition from the banking industry, which is likely to argue that the rules would force banks to curb lending, hurting economic growth. Banks and other interested groups have until Feb. 2 to submit comments on the rules. The rules would allow large banks to be shut down “without recourse to public subsidy and without disruption to the wider financial system,” Mark J. Carney, the governor of the Bank of England and chairman of the Financial Stability Board, said in a statement. The rules would apply only to so-called global systemically important banks — banks that are so big and interconnected that their problems can create economic and financial havoc. Banks in emerging markets would initially be exempt from the rules. If adopted, the rules would probably have the most impact on lenders like Deutsche Bank in Germany or BNP Paribas in France, which use a high proportion of borrowed money to do business. The tribunal also ruled that workers can make backdated claims, but only for a limited period. However, the ruling could be referred to the Court of Appeal, meaning a final decision may be years away. The ruling has widespread implications for companies where staff are required to do overtime as a regular part of their job. Lawyers said the tribunal was not clear on whether the ruling applied to workers doing voluntary overtime. But Caspar Glyn, a barrister specialising in employment law, told the BBC that the ruling effectively meant that: "Normal pay is normal pay and that should be paid when you're on holiday". Even though this was not spelt out in the ruling, this referred not just to compulsory overtime but to any overtime that is worked on a regular basis, he said. "Up until now, some workers who are required to do overtime have been penalised for taking the time off they are entitled to," said Howard Beckett of the Unite union. "This ruling not only secures justice for our members who were short changed, but means employers have got to get their house in order." 'Matter of urgency'The tribunal ruled on three cases - road maintenance company Bear Scotland versus Fulton, engineering firm Amec vs Law and industrial services group Hertel vs Wood. The employees won their original claims and the tribunal has now rejected the companies' appeals.
